Terms & Conditions

  • 1. General information
    A. The Parties
    “Antwork and all of Antwork’s Group Companies” are creators of agile, tech-enabled, and connected work environments, hereinafter referred to in this Agreement “the Terms” as “Antwork.”
    “The Member”, in these Terms refers to the party who desires to obtain usage rights through membership, whether an individual or company,” in accordance with the general conditions of “the Terms”, hereinafter referred to as “the Member.”
    B. Overview
    These terms represent the Member’s rights and obligations with respect to the usage rights of Antwork’s Online Platform and Phone Application (hereinafter referred to in these terms as the “Platform”) and the premises of Antwork or any premises powered by Antwork (the “Premises”) including but not limited to private, book-able and common spaces (the “Spaces”), Campus Basic Services, Add-on’s and any additional Business Services, Toolkits or other amenities (the “Services”). These terms are personal and legally binding to the Member. By reading and agreeing to the provisions hereunder, the Member is deemed to have agreed to comply with (i) the said provisions when using all of Antwork’s Platforms, and the Premises, Spaces and Services of Antwork and, (ii) the House Rules indicated in article 6 and, (iii) the Privacy Policy.
    C. Objective
    These terms outline the parameters of Antwork’s services and obligations covered as applicable to the Member.

  • 2. Platform & application
    A. Accessing the Platform
    The Platform can be accessed at platform.antwork.com, or by downloading the Antwork Phone Application from the Itunes store or the Iplay store. Antwork shall provide the Member with a limited, nonexclusive, nontransferable, revocable license to install its Application on his/her own device.
    B. Technology Release
    Antwork may require to access and/or use the Member’s relevant device to install a software from time to time. However, may not proceed with the said measure without prior approval from the Member. In this respect, the Member agrees to grant Antwork access to and/or use of his/her device, and understands that not granting Antwork this right of access and/or use, Antwork may not be able to provide the Member with its Services.
  • 3. Registration & memberships
    A. Registration
    The use of Antwork’s Platform, Premises, Spaces and Services is subject to prior registration and creation of an account to which prior identification is necessary for any registering Individual or Company. Individual accounts will allow use of the account to the registering individual and no other. Company Accounts will be asked to assign a “Primary Member” whose prior personal identification will be necessary. In order to allow registration and creation of an account, the Member agrees to provide Antwork with all the mandatory information required by the registration form, otherwise, the Member shall not be able to validate the creation of his/her account. The information provided by the Member through the registration process remains strictly confidential. Once registered, the Member will be asked to create a username and password through which the Member can access Antwork’s Platform, and consequently the Premises, Spaces and Services. The Member shall take all necessary precautions to ensure the confidentiality and secure use of his/her user name and password. The Member is solely responsible for his/her username and password and in particular all transactions made via his/her Account. In case of fraudulent use of any Member’s username and password, be it an individual or company Account, the Member undertakes to notify Antwork in writing within the shortest possible time. Antwork shall not be held liable whatsoever should any Member Account be compromised whether by its own users / employees or any other person.
    The Member undertakes not to provide any false information or illegally represent any third party or refuse to comply with any Antwork request in this regard. The Member agrees to immediately update his/her profile should his/her relationship with the company listed in his/her profile changes or ends. If his/her Membership is provided by a third party (company or employer), the Member’s membership will be cancelled without any liability should the company/employer terminate the Member’s services. In this respect, all companies/employers are required to notify Antwork immediately upon termination of services to any Member granted access through a company membership.     A. Memberships
    As part of the registration, Antwork offers the Member subscription to one of various Membership Packages (“Packs”) allowing him/her access to Antwork’s Platform. The content and practicalities of each Membership “Pack” is detailed on: www.antwork.com. All Membership Packs provide either limited or unlimited entry to a selected Antwork Group Company Campus depending on the selected Membership Pack. Upon subscription to any Membership Pack, the Member will receive a notification with the number of entry days granted to the Member according to his/her selected Membership Pack, noting that the days of access will be reflected as a number of credits in the member’s account. Each full entry day is equivalent to 200 (two hundred) credits. In the case of Company Accounts, the Primary user may choose to add up to any number of users (employees) under his/her Company Account and may choose, at his sole discretion, any specific Level of Access for each user including allowing users to act as Account Administrators if desired. Level of Access is defined by the ability, or lack thereof, to purchase credits, spend credits and by the limitations on what credits may be used to purchase or book through the Antwork Platform. It is specified that Antwork’s Membership Packs can and may be modified by Antwork at any time, provided that any amendment shall strictly apply after such modifications have taken place. They shall not affect any running membership subscriptions and will take effect upon completion of the Member’s current Membership month.
  • 4. Fees, credits & payments
    A. Fees
    Fees for Antwork’s Membership Packages and costs of all of its Services are detailed on the Platform and may be revised and amended as seen necessary at Antwork’s sole discretion without prior notice or notification, and without any liability whatsoever.
    B. Credit System & Payments
    Fees for Memberships, Bookings, Campus or Business Service Bookings, Top-ups or any other service provided through the platform must be paid using the Member’s pre-identified and pre-approved payment method, in combination with Antwork’s Credit system, which is Antwork’s specified currency system. Every $1 (One United States Dollar) is equivalent to 10 (ten) Antwork Credits. The Member may purchase Credits or Credit Packages at any time directly from his/her Member Account using his/her per-identified method of payment. All Member Billing Details and Invoices can be viewed by the Member only by selecting the “Billing Details” tab in the Member’s personal profile section. The Member’s Account Summary can be viewed by selecting the “Credit Activity” tab in the same section.
    C. Upgrades
    Membership upgrades are effective immediately upon payment confirmation. Fees are calculated by deducting the current membership cost from the total amount charged.
    D. Credit Expiry
    Credits provided as part of the Member’s Membership Packages expire every month at Membership renewal. Unused credits expire at the end of the month and are replenished at the start of every new Membership month. Credits and Credit Packages purchased directly by the Member through the online Platform are valid for one full year from purchase date and do not expire at month’s end.
    E. No Refunds
    Membership fees are non-refundable. Credits and credit packages are non-refundable.
    F. Fee Modification
    Antwork reserves the right to change or modify fees for any of its Membership Packs, Book-able Spaces, Services, Add-on’s Toolkits or any Book-able Programs or Events at any given time, without prior notice. Members will be notified in the event that any fees or costs do change, and changed fees shall be considered applicable to any booking placed immediately after the announcement and application of such changes.
  • 5. Services provided by antwork
    A. Access and Use of the Premises and the Spaces
    Antwork shall provide the Member access and use of the Premises and Spaces only through Membership and as detailed on www.antwork.com, and this shall mainly consist of the following:

    - Definition of Membership Access:
    Membership Access includes an active Online Platform Membership, access to the Antwork Campus Common Areas, access to Common Work Areas, access to Work Lounges, and access to any unoccupied Hot Desk throughout the day of Access and as specified by the Membership package. Membership Access also Includes basic level 1 Wi-Fi, level 1 Printing, free House Events, access to all Book-able Spaces through the Antwork Platform and Phone Application Booking System, Access to the Antwork Online Community, Campus Services and Add On’s, Business Services & Toolkits, and to Antwork’s Programs & Events Calendar. Antwork Premises, Spaces and desk reservations are subject to availability. The Member shall abide by the time he/she booked at the Spaces. The Member can access the Premises and Spaces either 24h/7d a week or as permitted by his/her Membership whether for full days (which shall start at 8a.m. and end at 8p.m.) or half days (which shall start at 8 a.m. and end at 2 p.m. or start at 2 p.m. and end at 8 p.m.), or for three days such as MWF or TTS weekly. The access to such Spaces will be defined by a number of days per month according to the Member’s selected membership and shall be reflected in the Member’s account in credits.


    - Definition of Book-able Spaces:
    Hot Desk & Day Access – Access is obtained by booking a Hot Desk, which allows the Member to use any available Hot Desk or any available shared Workspace depending on the Member’s preference. Meeting Rooms, Huddle Rooms, Meeting Lounges, Quiet Lounges and other meeting facilities - are setup for meetings and book-able by the half hour or hour. Peak Hour rates apply. Event Spaces - are fitted with modular furniture suitable for workshops, lectures or other such events, with various capacities, and book-able by Slots of 3 hours. Dedicated Desks - are work desk to be selected and reserved for full month durations at a time. Only book-able monthly and comes with an automatic upgrade to Dedicated Desk Membership. Private Offices - are closed private space for one or two persons or more. Spaces vary in size and location and are flexible, furnished and ready to use one full month at a time. Office residents registered under a company or team name, are granted access to the online platform and common areas, under that team or company name.

    - Definition of Online Community:
    Includes but is not limited to the ability to view, connect and interact with Antwork’s online community of Members.
    - Definition of Workspace Services:
    Include complimentary cleaning & maintenance and accommodates for additional free or paid services depending on the availability of such facilities and services at each Antwork location such as parking, locker, mailbox, fitness studio, showers, etc… Add-on’s include printing and internet upgrades, dedicated phone line, call center and cloud storage, among a growing marketplace of workplace services. Multiple Services are made available through the Platform.

    - Definition of Business Support:
    Business support services are provided by Antwork or through its community as well as Third Parties, and are made available through the Antwork Platform and Phone Application. Such services include but are not limited to IT & Networking Services, Accounting Services, Personnel Services, Official Paperwork Handling, Website Hosting, Branding, and Legal Advisory. Toolkits are Business Services bundled in packages with smart pricing targeting the needs of startups and growing companies. The pricing of such services varies based on the different offerings of the service suppliers and may be offered directly by Antwork or by Third Parties.

    - Definition of Programs & Events Calendar:
    Includes the ability to view Antwork’s Calendar of Programs and Events including House Events, certain member events, workshops, talks, seminars, and other such events that are scheduled to be held within Antwork Group Company premises either by Antwork or by a third party. Antwork may not be the primary provider of all of the services it offers through the platform, and therefore retains the right to change or modify the list of available services at its own discretion and at any time without prior notice. Antwork will not be held liable for third party services or their costs, performance, or results. Antwork retains the right to charge nominal fees for making such services available to its community through its Online Platform and Phone Application. Antwork retains the right to change or modify the list of services and or their prices at its own discretion without prior notice at any time.
    B. Management of the Services
    Antwork shall control the management, security and maintenance of the Premises, and the Spaces in accordance with the rules and provisions of its internal system to facilitate the operation of such Premises and Spaces. Therefore, Antwork shall be liable to the following: - Providing electricity services and electrical generators;
    - Providing level (1) internet defined as 2 Mbps per user;
    - Providing security services for the Premises;
    - Providing cleaning services;
    - Providing fire extinguishers;
    - Providing maintenance for all private and common areas specified for common use for all sections in the Premises, including but not limited to hallways, elevators, stairs and escalators, toilets and all that is related to common use;
    With respect to any services listed above, provided by Antwork to the Member, or the obligations incurred by Antwork under these terms, Antwork shall not be considered liable for the failure of providing or implementing of any obligation for any reason beyond its control due to a strike or damage or emergency or order to decision issued by any Public Authorities, or difficulty in providing the necessary sources of energy and services (including inter alia electricity, internet) due to an exceptional or emergency security situation, or lack of access to equipment, parts, or personnel needed to secure these resources or perform these duties, or due to exceptional and emergency security situation, or due to an act or negligence of the Member or employees or customers or contractors or suppliers or any person related to the Member. Antwork will not be responsible in any way for any unexpected or indirect damages caused to the Member for any reason. Antwork may take any action it deems appropriate to control the process of exit and entry to and from the Premises and Spaces, including the closure of some exits and entries, and/or limit access to the Premises and Spaces or to prevent or prohibit some people from entering for security reasons. Antwork can prevent the access to the Premises and Spaces at any time it deems fit, and deny entry to its Premises any member, visitor, member guest, or any person whose presence it deems threatening to the safety or security of its Premises or Spaces or members, or whose presence it deems threatening to the proper functioning of the Premises.
    Additionally, Antwork retains the right to:
    - Organize and run marketing and advertising campaigns on the Premises. It is agreed that Antwork has the exclusive right to invest and place advertisements in the public spaces and common areas of the Premises;
    - Organize and hold events on the Premises. It is agreed that it is Antwork has the right to organize, manage and hold events of all kinds on Antwork Premises, including run advertising and promotional campaigns for such events. For the avoidance of doubt, the Member agrees that Antwork reserves the absolute right to use all or part of the common areas directly or by third party in any way it deems appropriate, including commercially, during any time, and to organize events, recreational, cultural, and other activities, as well as exhibitions and shows. Antwork also retains the right to place stands for leasing, and to run campaigns to inform the public, broadcast advertisements, and to transmit or permit any other person to broadcast, transfer or transmit advertisements or audio and/or visual programs, etc. without the Member’s right to object in this respect for any reason whatsoever.
  • 6. House Rules
    A. Compliance
    The Member must comply with all the provisions of these terms and the internal system rules of the Premises and Spaces, as well as the circulars and amendments issued by Antwork. In addition, the Member must comply with all relevant laws and regulations in the conduct of his/her business. The Member must not do anything illegal or that may interfere with the use of the Premises and Spaces or that may cause nuisance or disturbance or loss or damage.
    B. COVID-19 measures & requirements
    Please take note of our new measures:
    1. Antwork is designed to be a touchless workspace! Use your app to scan in to our locations, enter your office, or meeting room, control your room lighting & climate, and to make payments on campus… this will help you minimize contact with doorknobs, keys, switches and cash. We are always happy to assist you, but urge you to make all your bookings from your app to keep contact to a bare minimum!
    2. Campus entry has been restricted to the main entrance only, where we have placed a sanitization booth at the main door. The parking gate will no longer be in use, and the main wooden gate will be reserved for exit only. Directional signage has been placed for clarity.
    3. Sanitization: We have increased the frequency of our general cleaning procedures and are adhering to a strict surface sanitization routine.
    4. Natural Ventilation is key to keeping the internal environment of our workspaces healthy.
    5. Seating plans: All of our seating layouts have been adjusted to recommended WHO safety physical distance measures.
    6. Masks will be worn by all Antwork employees and support staff. Cleaning staff are to wear proper protective gear including gloves.
    7. Incoming packages will be disinfected at the security booth before dispatch to destination.
    8. Deliveries will be sanitized upon arrival and kept at the main entrance for collection by members. Food & other delivery personnel will not be allowed on campus.
    9. Elevators have been disabled to limit risks of contagion.
    10. Car Parking: Our adjacent parking facility has been notified to ask members to self-park, and will only park cars when necessary, using one-use gloves when doing so.
    11. Guest Entry will be carefully monitored, members are required to inform the front desk, or confirm invitation upon guest arrival.

    Members are asked to adhere to the following requirements for the safety of self and others:
    1. Masks are to be worn by anyone walking through or using a shared space, and all common areas of campus. If you did not bring your own, masks are available at the front desk.
    2. Safe distancing measures are to be respected, by keeping at least 1.5 meters distance to anyone within the space. We ask members not to change the placements of any seating, as current placement is strictly compliant with distancing requirements.
    3. Sanitizing solution bottles are made available throughout campus, please remember to keep your hand clean, and sanitize your hands before handling printers, water coolers, or door knobs!
    4. Elevators use is restricted to one person at a time.
    5. All deliveries (including food) will be kept at the main entrance for your collection. We recommend discarding the outside packaging of deliveries whenever possible.
    6. Alert! Please leave campus as soon as you experience any signs of illness. This is urgent for the safety of our workplace.

    New Hot Desking Procedures:
    1. The app has been updated to accept hot-desk bookings to make sure you your spot is reserved, since our capacities have been reduced.
    2. Do not eat at your workstation, areas have been designated for food for your safety.
    3. Notify us when you are leaving for the day in order for us to re-sanitize the workstation.
    4. Please use headsets if listening to / watching content on your screen.
    5. Take your calls in the garden, or book a meeting space for your video- conferences.

    Private Office Recommendations:
    1. Keep your office environment and private workstations clean and tidy to help make sanitization more effective.
    2. Keep your office well ventilated.
    3. Consult with us to adjust the seating plan in your office in order to ensure the safety of your employees. Our team are happy to assist you, and have a number of solutions to suggest

    Event Space Use Recommendations:
    1. Adhere strictly to all House Rules regarding sanitization upon entry, frequent hand-sanitizing, and keep your masks on!
    2. Adhere strictly to maximum occupancy recommendations advised by our team.
    3. Adhere to professional distancing recommendation of 1.5meters between event attendees in the space.
    4. Keep event space as well ventilated as possible.
    C. Use of Premises & Spaces
    The Member undertakes:
    - To comply with all the provisions of these terms and the internal system rules of the Premises and Spaces, as well as the circulars and amendments issued by Antwork.
    - To comply with all relevant laws and regulations in the conduct of business.
    - To not undertake any illegal action or any activity that may interfere with the use of the Premises and Spaces or that may cause nuisance or disturbance or loss or damage.
    - To not perform any commercial activity or celebration or promotion for goods within the Premises and Spaces or in any vehicles in the parking lots.
    - To not display or sell goods, or promote activities or distribute brochures or advertising flyers or any similar promoting items on the Premises and Spaces or on any vehicles in the parking lots.
    - To not sell or offer products or services of any religious, or political nature on the Premises and Spaces or in any vehicles in the parking lots
    - To not bring, offer or sell any illegal substances on the Premises and Spaces or in any vehicles in the parking lots.
    - To use all shared spaces provided by Antwork for member convenience with prudence including keeping kitchenettes, “Pantries” Refrigerators, cabinets, countertops and tabletops clean and tidy after use. All Member personal items shall be labeled with names and dates otherwise such items shall be thrown out by the end of each working week (Fridays).
    - To access Antwork Premises and Spaces within regular business hours (8am to 8pm) on regular business days from Monday to Saturday excluding public holidays (as listed in appendix A) or outside these business hours and business days for the purpose of using a Private Space alone.
    - To notify Antwork’s front desk of guest names, expected arrival time, and duration of visit. Upon arrival, said guests shall be asked to check in at the front desk whereby the Member will be notified of their arrival.
    - To not perform any activity that may disturb or endanger other individuals within the Premises and Spaces or its neighbors, nor use the Premises and Spaces for any immoral or unlawful purposes, nor violate any law or ordinance or have any indecent attitude or behavior..
    - To not smoke including electronic smoking, in any indoor space including common areas and all private work spaces.
    - To not bring and/or operate inflammable or incinerating substances onto the Premises, or anything with unpleasant or irritating or harmful odors, as well as machines and engines, or to carry out manufacturing and packaging that may produce disturbing sounds on the Premises and Spaces as Antwork has a Book-able Space equipped and dedicated for such activities and to not disturb the neighbors in any kind including with loud conversations.
    - To not use any kind of additional lighting or heating equipment whatsoever on the Premises and Spaces, unless preapproved.
    - To not, at any time, block corridors, stairs, elevators, or any entrances or exits of any common areas on the Premises, Spaces and within the parking lots.
    - To not bring heavy machinery, devices or equipment to the Premises and Spaces without Antwork ’s prior written consent.
    - To not use any of the elevators originally specified for the transportation of individuals and building visitors for the transport of goods or commodities, or food or waste, equipment or furniture of any kind.
    - To not install tents or separators of any kind or material whether on or above desks or the entrance to Private Spaces or on doors, or display, or change any color or shape of Private Space doors or entrances, nor display advertising banners or decorative items or lights.
    - To not harm or disrespect the physical Premises and Spaces, equipment, fixtures, fittings and furnishings, and take good care of and keep in good repair the Premises and Spaces, equipment, fixtures, fittings and furnishings, and to preserve the above as a prudent administrator (pater familias).
    - To not bring any pets onto the Premises and Spaces except on specified days that will be clearly announced to all members.
    D. Security
    The Member acknowledges and accepts that for security purposes:
    - The Premises and Spaces are monitored by cameras (CCTV) at all times.
    - Antwork may ask the Member to show his/her personal identification document to gain access to the Premises and Spaces at any given day.
    - Antwork may only disclose information and personal data for security reasons and only if necessary.
    - In this respect, the Member acknowledges and accepts these security measures and procedures and therefore undertakes to notify any of his/her guests about such procedures. In addition, the Member undertakes to keep his/her private space and any of his/her assets secure at all times. Therefore, the Member shall securely close all the doors, windows, or other entries when said private space is not being used or is vacant.
    - The Member acknowledges and agrees that Antwork has the right to enter his/her private space to securely close all doors, windows and other entries in case they were not closed by the Member or in any case of emergency. In this respect, the Member discharges Antwork from any responsibility or liability for any reason whatsoever with regards to the matter hereto.
  • 7. Membership termination & cancellation
    The Member can terminate and/or cancel the account and/or membership at any time. In this respect, Antwork shall not provide any refunds upon termination or cancellation of the Member’s account and/or membership in relation to any already paid amounts. In addition, Antwork reserves the right to terminate and/or to cancel the Member’s account and/or membership, at its own discretion, and to cease to renew the Member’s subscription for any or all Services at the end of his/her subscription period, in case the Member is in breach of one of his/her obligation under these terms.
  • 8. Liability
    In no event whatsoever should Antwork be held responsible for any third party charges incurred by the Member’s internet provider and/or telecommunication services providers in relation to or arising from the Member’s use of the Application, or, for any damages caused by any malfunction or failure of Antwork’s software, system, hardware or connectivity or from any kind of improper and illegal use of the Application or for any loss of content or data on the Member’s device, or, for the content of any advertisements or any links, products, services or other materials relating to any third party products, services, advertisements or other materials. In no event whatsoever should Antwork be held liable for any malfunction or failure of Antwork software, system, hardware or connectivity. In this respect, the Member agrees to waive his/her right to take any measure or action towards Antwork with regards to the said matter.
    The Member and/or the Member’s employees, agents, guests, visitors, users or invitees shall exempt Antwork of any liability related to any damage resulting from any claims, judicial procedures, costs, damages, expenses and losses arising from or relating to:
    - Any violation or non-compliance or non-implementation of any of the obligations and terms and conditions of these terms.
    - Any direct or indirect damage that is not attributed directly to Antwork and is related to the Member’s property as a result of poor or damaged condition to any part of the Premises or any of its equipment, appliances or electrical supplies, act of the Member or the Member’s visitors, and/or suppliers, and/or clients, and/or users, or their failure or negligence, any damage, whether direct or indirect, due to a malfunction of any service provided by Antwork, and any liability for third party products or services.
  • 9. Intellectual proprietary rights
    Intellectual Property Rights refers to all and any patent, patent application, copyright, know-how, database right, registered trade mark, trade mark application, trade name, service name, business name, design right, utility model, systems, data base, seminars, workshops, specific programs, services, packages, bundles, toolkits, recipes or other intellectual or industrial property right and including for the avoidance of doubt copyright in software and computer algorithms, applications and the right to make applications for any of the foregoing, extensions and renewals thereof and all rights of a similar nature (the Intellectual Proprietary Rights) used in Antwork’s ordinary course of business. In this respect, the Member agrees that Antwork is the sole owner of the Intellectual Property and that he/she undertakes not to use such Intellectual Property, information or materials in any way whatsoever except as permitted by these terms.
    Moreover, the Member must not directly or indirectly take, copy or use any information or Intellectual Property belonging to other members of Antwork or member companies or any of their guests, including and without limitation personal names, inventions, original works of authorship, developments, concepts, improvements, designs, drawings, discoveries, blogs, ideas, trademarks, member databases, trade secrets or any other intellectual property, or modified or altered versions of the same.
    In addition, the Member acknowledges that any violations of this clause will constitute a breach of the terms detailed in these Terms and will cause irreparable harm to Antwork which shall have the right to terminate these terms without any compensation or indemnification whatsoever. The Member shall concur that all and any of its affiliates, shareholders, directors, managers, employees or personnel (if any) shall be considered bound by the same obligations.
  • 10. Endorsements and testimonials
    The Member acknowledges that all testimonials and endorsements of any type, format or nature posted by users are not verified by Antwork and shall not represent Antwork. The Member shall not under any circumstances hold Antwork responsible for their contents.
  • 11. Applicable law & dispute resolution
    These terms are interpreted and enforced in accordance with English Law.
  • 12. Severability
    Every provision in these terms is intended to be severable. If any term or provision hereto is illegal or invalid for any reason whatsoever, such illegality or invalidity shall not affect the validity of the remainder of the terms or provisions of these terms and the parties agree that they will negotiate in good faith to enter into an agreement that produces the same or substantially similar results.
  • 13. Waiver
    The failure of Antwork Ltd and Antwork to enforce any provision(s) of these terms at any time shall not be considered a waiver of such provision(s), nor shall such failure affect the validity of these terms in any way. The failure of either party to exercise any such provision(s) shall not be construed as a waiver of any continuing or succeeding breach of such provision, a waiver of the provision itself, or a waiver of any other right under these terms.
  • 14. Confidentiality
    The terms in these Terms are confidential. The Member acknowledges and agrees that he/she shall not disclose these terms unless required to do so by law or official authority. This obligation shall survive the termination of these terms.
  • 15. Notices
    All formal notices must be delivered in writing to the address provided in the first section in this document.
  • 16. Apple device & application terms
    In the event the Member is accessing the Services via the Application on a device provided by Apple Inc. (“Apple”) or an application obtained through the Apple App Store, the following shall apply:
    - Both the Member and Antwork acknowledge and agree that these terms are concluded between the Member and Antwork only, and not with Apple, and that Apple is not responsible for the Application or any content made available through the Application.
    - The Application is licensed to the Member on a limited, non-exclusive, non-transferrable, non-sub- licensable basis, solely to be used in connection with the Services for the Member’s private, personal, non-commercial use, subject to all the terms and conditions of this clause as they are applicable to the Services.
    - The Member will only use the Application in connection with an Apple device that the Member owns or controls.
    - The Member acknowledges and agrees that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application.
    - In the event of any failure of the Application to conform to any applicable warranty, including those implied by law, the Member may notify Apple of such failure; upon notification, Apple’s sole warranty obligation to the Member will be to refund the Member the purchase price, if any, of the Application.
    - The Member acknowledges and agrees that Antwork, and not Apple, is responsible for addressing any claims the Member or any third party may have in relation to the Application.
    - The Member acknowledges and agrees that, in the event of any third party claim that the Application or the Member’s possession and use of the Application infringes on that third party’s intellectual property rights, Antwork, and not Apple, will be responsible for the investigation, defense, settlement and discharge of any such infringement claim.
    - The Member acknowledges and agrees that, in his/her use of the Application, he/she will comply with any applicable third party terms of agreement which may affect or be affected by such use.
    - Both the Member and Antwork acknowledge and agree that Apple and Apple’s subsidiaries are third party beneficiaries of the terms of this clause, and that upon the Member’s acceptance of these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these terms against the Member as the third party beneficiary hereof.

    Antwork reserves the right, at its own discretion to change or modify, add or remove portions of these Terms at any time without prior notice and for any reason not prohibited by law. In the event that any changes are made, the Member shall be immediately notified of such changes, and such changes shall form an integral part of the Terms.
